<br />PUBLIC PARTICIPATING JURISDICTION AGREEMENT <br /> <br />between the <br /> <br />TRI-V ALLEY BUSINESS COUNCIL EDUCATIONAL COLLABORATIVE and the <br />CITY OF DUBLIN, CITY OF LIVERMORE, <br />CITY OF PLEASANTON, CITY OF SAN RAMON <br />and the TOWN OF DANVILLE <br /> <br />THIS PUBLIC PARTICIPATING JURISDICTION AGREEMENT (this "Agreement"), <br />is made and entered into as oflhis TH day of ,2006, between the Tri-VaIley <br />Business Council Educational Collaborative ("TVBCEC"), and the City of Dublin, City of <br />Livermore, City of Pleasanton, City of San Ramon, and the Town of Danville, collectively <br />referred to as the "PARTICIPATING PUBLIC JURISDICTIONS" or "PPls". TVBCEC and <br />the PP1S together are referred to as lhe "Parties." <br /> <br />WHEREAS, the PARTICIPATING PUBLIC JURISDICTIONS recognize lhe need for a <br />private, home buyer education organization working regionally 10 promole affordable <br />homeownership and rental opportunities in lhe Tri.Valley region; and, <br /> <br />WHEREAS, the Tri-Valley Housing Opportunity Center ("Center"), currently privalely <br />owned and operaled by Tri-Valley Business Council Educalional Collaboralive, can provide and <br />has provided such services; and, <br /> <br />WHEREAS, the PARTICIPATING PUBLIC JURISDICTIONS desire to provide funds <br />to the Center for this purpose; and, <br /> <br />WHEREAS, immediately following the execution of this Agreement, the Center will <br />undertake efforts to form a non.profit corporation under stale and federal law; and, <br /> <br />WHEREAS, the Parties further recognize that it is necessary to provide for an interim <br />treasurer and manager of financial affairs of the Center pending formation of a not for profit <br />corporate slructure for the Cenler. <br /> <br />NOW, THEREFORE, the Parties agree as follows: <br /> <br />1. The PPls shall provide funding to the TVBCEC or the Center, upon its incorporation as a <br />nonprofit under stale and federal law, in the amounts and for the purposes set forth <br />herein. <br /> <br />2. Until such time that the Center is incorporated and achieves nol for profil stalus under <br />stale and federal law ("the incorporation date"), the TVBCEC will serve as treasurer and <br />manager of the day-to-day financial affairs of the Cenler.
