7. The City reserves the right to revoke approval of the encroachment permit should the <br /> PD,aJPCFMA fail to abide by the established and agreed upon performance standards <br /> including, but not limited to: <br /> <br /> a. Traffic and parking control devices, including street barricades, shall be erected <br /> in place no later than one (1) hour prior to the commencement of regular <br /> customer service hours on any given market day. <br /> <br /> b. Pedestrian control devices, if any, shall be erected no later than one half-hour <br /> prior to the commencement of regular customer service hours on any given <br /> market day. <br /> <br /> c. All farmers' market vendors, growers and participants, regardless of membership <br /> with the PCFMA, shall use haul routes as designated by the City's Public Works <br /> Department. The PDA/PCFMA may establish within its rules of operation for <br /> the Plumton Certified Farmers' Market nominal fines for using participants <br /> using non-designated haul routes. <br /> <br /> d. The PDA/PCFMA shall be responsible for providing appropriate trash <br /> receptacles within the farmers' market 'Common area'. The PDA/PCFMA is <br /> responsible for removing these receptacles, and depositing the waste into <br /> appropriate containers. The PDA/PCFMA may establish a contract with a nearby <br /> business establishment to accept the waste for pick-up by the City's refuse <br /> collection agency. <br /> <br /> e. The PDA/PCFMA shall be responsible for ensuring that West Angela Street, the <br /> Delucchi Memorial Park, private parking lots and other businesses, sidewalks, <br /> parks and streets within the immediate area of the farmers' market (i.e., Main <br /> Street, First Street, Neal Street) are maintained free of litter, organic material, <br /> excess water, and contaminants. Should the City fred that the Downtown area <br /> immediately adjacent to the farmers' market is not maintained in such a manner, <br /> the City shall have the right to charge PDA/PCFMA for any maintenance work <br /> believed necessary by the City to return the area to its previous litter-free and <br /> safe environment. <br /> <br /> f. The PDAJPCFMA shall indicate in its rules and regulations of operations for <br /> growers and vendors participating in the farmers' market, regardless of any <br /> membership with the PCFMA, that sidewalks, private driveways and parking lots, <br /> street medians, parkways and streets shall not be subjected to any temporary or <br /> permanent drilling, hammering or installation of anchoring devices for umbrellas, <br /> awnings display tables, etc. The City shall hold the PDA/PCFMA responsible <br /> for repairing any damage to such areas. <br /> <br /> Page B-2 <br /> <br /> <br />
