<br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 06-019 <br /> <br />RESOLUTION VACATING A PORTION OF RIGHT OF WAY <br />ADJACENT TO THE BERLOGAR PROPERTY <br />AND AUTHORIZING THE CITY MANAGER TO EXECUTE <br />A QUITCLAIM DEED <br />CONCERNING THIS RIGHT OF WAY <br /> <br />WHEREAS, in 1970, right of way was dedicated to Alameda County (the right of way at that <br />time was in the unincorporated area of Alameda County) for future widening of <br />the then existing Vineyard Avenue adjacent to what is now the Berlogar property <br />(Lot 22 of the Vineyard A venue Corridor Specific Plan); and <br /> <br />WHEREAS, the right of way (and other property) were annexed to the City of Pleasanton in the <br />early 1990's; and <br /> <br />WHEREAS, such widening of the right of way did not occur and is not anticipated to occur; <br />and <br /> <br />WHEREAS, the City of Pleasanton does not need this right of way and a portion of this right of <br />way along the Berlogar property, as described in the attached Exhibit "A" and <br />depicted on the attached Exhibit "B", should be vacated; and <br /> <br />WHEREAS, it is the intention of the City Council to summarily vacate this right of way <br />pursuant to Chapter 4 of Part 3 of Division 9 of the California Streets & Highways <br />Code as this excess right of way has not been used as a street and is not needed for <br />that purpose; the use of this portion of what is now former Vineyard Avenue as a <br />vehicular right of way in general has been superseded by relocation of Vineyard <br />A venue; no property access will be terminated by the vacation of this excess right <br />of way; and this excess right of way does not contain any public service easement <br />and no public facilities are within it; and <br /> <br />WHEREAS, the vacation of this right of way along the Berlogar property is consistent with the <br />City's General Plan and the Vineyard A venue Corridor Specific Plan; and <br />
