<br />(1) Odd F ~1l0~ Retains Owners hiD and Control: For over 35 years, the City bas worked witb <br />the Odd Fellows In an infOIma/ manner when issues have arisen regarding the Cemetery's maintenance. <br />Because the City does not own or control the Cemetery, the City is not (and unless the City acquired the <br />Cemetery would not be) responsible for the Cemetery's maintenance. Additionally, as dilK:ussed below <br />the City's ability to regulate the Ccmetery'S maintenance is limited to requiring weed abatement. If ~ <br />Odd Fellows rctained ownermip, tbe City could continue to make inquiries to the Odd Fellows <br />regarding the Cemetery's maintenance as the City receives requests and complaints from citizens, while <br />recognizing that the City docs not have autbori~ to mandate standards of mainlenance outside of weed <br />abatement, and any maintenance issue would be a privau: matter between the CemetC'ly and private <br />parties. Mol'"Cl>Vel", notwithstanding lhc Cemetery's obligations, if any, for the pe:rpetual ClIIl: of plots <br />sold between 1992 and 2002, lhc Cemetery's management would likely eonlc:nd that the condition of the <br />Cemetery is adequate ;md expected for a non-endowment care OCDIerery. <br /> <br />(2) Community Involvemenc The City could encourage local organizations and groups. such as <br />historical SQcieties, churches, schools and other citizen groups, to cooperate with the Odd Fellows 10 <br />help maintain the grounds of the Memorial Garden. rcsc:arch cemetC'ly records, and foSTer edllCation <br />progr.uns related to the Cemetery. Under this scenario, the Cemetery would retain ownership and <br />control. The City would not be actively involved in the Cemetery's maintenance or any olber projects <br />WJdertaken by the comnnmity. <br /> <br />(3) Museum Involvement: Because oftbe Cemetery's historic significance to pl-'I"m<:m, the <br />City could explore opportunities for active participation by The Museum on Main Street (fonnerly the <br />Amador Livermore Valley Historical Society Museum). This involvement could nmge from researcb <br />~ public ~dl1l('nr;...n on PIt1'..n~ntoD'S: historic figures buried in the C~etery to the coordinatiOtl of <br />maintenance and preservation cfforts of the Cemetery's historic graves and plots. Through infonnation <br />provided by the Veterans of Foreign Wars, staffleamed that there arc approximately 39 Pleasanton <br />historic figures and families buried in Memorial Gardens. II As provided in the rust and second <br />scenarios above, the Cemetery would retain ownership and control of the Cemetery and lhe City's <br />participation would be limited 10 fostering the working relationship between the Cemetery and Mus<<UtD. <br /> <br />(4) Veterans' GrOUD Involvem!;Dl: Tbe City could encourage Pleasanton's three Veterans <br />groups--thc American Legion, lhe Vetcrans of Foreign Wars. and the Veterans of Foreign Wars <br />Auxiliary-to maintain and preserve the veterans' graves and plots. According to a member of lhe <br />Veterans of foreign Wars Auxiliary who keeps records of existing historic and veterans' graves in <br />Pleasanton, there arc 198 veterans buried in Memorial GardenS. Some of these graves 1IR also historic. <br />For example, three veterans buried there servcd in the American Civil War and two veterans served in <br />the Spanish-American War. More recent veterans are also buried in lhe Memorial Gardens. <br /> <br />The Department of Veterans Affairs (V A) furnishes upon request and at no charge a government <br />headstone or marker for the grave of any deceased eligible veteran in any cemetery. For al1 deaths <br />occurring before September J 1,2001, tbe V A mIl provide" headstone or marker only for graves that <br />are Dot marked wilh a private headstone. For deaths occurring on or after September 11,2001, the VA <br />will furnish headstones for eligible veterans who are buried in private cemeteries.
