If all Council members are present, but one or more Council members With respect to any matter in which the City Council is required by law to take final action, a tie vote on a motion shall be ~ ii~. With respect to any matter on which the City Council is considering the matter on an appeal, a tie vote on a motion shall be deemed no action and the decision which was appealed shall stand. Any person whose application is denied as a result of this policy may reapply in accordance with the provisions of the Pleasanton Municipal Code. Nothing contained in this policy shall prohibit a Council member from participating in a decision involving a resubmitted application if the Council member is no longer required to abstain. O. Any Council member may continue an item (not subject to a leg~ or City-imposed deadline) to the next Council meeting or other date agreeable to a majority of the Council. This continuance requires a majority vote of the Councilmembers present at the meeting. An agenda item may be continued ~iii~ using this procedure only oncc. Anyone may request a continuance of an item and the Council, by a majority vote, may grant ~ one 'amc continuance, ~, ~, request for a subsequent continuance may be granted by a 4/5 vote of the Council only if it finds that: the need for the continuance was beyond the control of the person requesting i~i-; and the need for the continuance arose after (a) the date of the notice of public hearing was published if the item is subject to a public hearing, or (b) the time the Council agenda was posted for items not subject to a public hearing.
