Growth Management Agreement Provisions <br /> <br />1. Approve Minor Modification for Tract 6320 as approved by <br /> Zoning Administrator on March 16, 1993, subject to the <br /> following conditions. <br /> <br />2. Except as expressly modified herein, the existing growth <br /> management program of the City of Pleasanton, its ordinances, <br /> regulations, policies and procedures shall apply to this <br /> project until completion of the development plan. <br /> <br />3. If for a continuous period of six (6) months, <br /> <br /> · during the construction season, no substantial <br /> construction work is done on work required by the <br /> subdivision agreement; or <br /> <br /> · after substantial completion of the improvements required <br /> by the subdivision agreement, no building permits have <br /> been applied for by owner for construction of dwelling <br /> units; or <br /> <br /> · after completion of the model homes, no active marketing <br /> program is underway (such program shall include but is <br /> not limited to a sales office/model home complex, signage <br /> and advertising); the Zoning Administrator, after <br /> notification to the Owner, may initiate a proceeding and <br /> hold a public hearing to determine whether the project <br /> has been making substantial progress toward completion of <br /> its development plan. <br /> <br /> If a final determination is made that a project is not making <br /> substantial progress on its development plan, said <br /> determination shall specify in detail those items on which no <br /> substantial progress has been made for a continuous period of <br /> six (6) months. <br /> <br /> After a final determination that a project is not making <br /> substantial progress on its development plan, Owner shall have <br /> sixty (60) days to cure or commence and diligently prosecute <br /> cure. <br /> <br /> If the Owner does not cure or commence and diligently <br /> prosecute cure, the City Council may take action to declare <br /> that the project's unused growth management approvals have <br /> lapsed. <br /> <br />4.
