Growth Management Agreement Provisions 1. Approve Minor Modification for Tract 6320 as approved by Zoning Administrator on March 16, 1993, subject to the following conditions. 2. Except as expressly modified herein, the existing growth management program of the City of Pleasanton, its ordinances, regulations, policies and procedures shall apply to this project until completion of the development plan. 3. If for a continuous period of six (6) months, · during the construction season, no substantial construction work is done on work required by the subdivision agreement; or · after substantial completion of the improvements required by the subdivision agreement, no building permits have been applied for by owner for construction of dwelling units; or · after completion of the model homes, no active marketing program is underway (such program shall include but is not limited to a sales office/model home complex, signage and advertising); the Zoning Administrator, after notification to the Owner, may initiate a proceeding and hold a public hearing to determine whether the project has been making substantial progress toward completion of its development plan. If a final determination is made that a project is not making substantial progress on its development plan, said determination shall specify in detail those items on which no substantial progress has been made for a continuous period of six (6) months. After a final determination that a project is not making substantial progress on its development plan, Owner shall have sixty (60) days to cure or commence and diligently prosecute cure. If the Owner does not cure or commence and diligently prosecute cure, the City Council may take action to declare that the project's unused growth management approvals have lapsed. 4.
