Resolution No. 94-27 <br />Page 2 <br /> <br />WHEREAS, the initial number of units from developers proposing to participate in the <br /> Modified Program (together with units from non-participating developers) totalled <br /> 701 units for 1994, 746 units for 1995, 590 units for 1996, 251 units for 1997, <br /> 150 units for 1998 and 96 units for 1999; and <br /> <br />WHEREAS, in December, 1993, a Council Committee (Mayor Tarver and Vice Mayor <br /> Dennis) reviewed these totals and felt that the numbers were in keeping with the <br /> intent and goals of the Medified Program; and <br /> <br />WHEREAS, since the City received the initial requests for reallocation, three developers have <br /> requested changes: A-M Homes, by reverting its property to acreage, has <br /> terminated its growth management agreement with the City and its 47 units (24 <br /> in 1994; 23 in 1995) have dropped out; Ahmanson Developments (Laguna Oaks, <br /> Unit A) has sold its project to Davidon Homes and Davidon Homes has requested <br /> only 31 units for 1994, retained 66 for 1995 and requested 50 in 1996 and 14 in <br /> 1997; and Prudential (Spanish Oaks) has indicated that it will move its 231 units <br /> in 1995 to 1997 if to do so will create room in the Growth Management Program <br /> to accommodate Signature Properties' project in Hacienda Business Park, <br /> provided, however, that if that latter project is not granted growth management <br /> approval, Prudential requests its original reallocation (in 1995) be honored; and <br /> <br /> WHEREAS, in addition to the projects to which the Modified Program is applicable, the <br /> developers of the F-xluus Heights project (the Yees) have also requested to include <br /> their six unit project in the Program, with the units to be reallocated to 1997; and <br /> <br /> WHEREAS, developers participating in the Modified Program have or will have subdivision <br /> agreements, the terms of which should be consistent with the growth management <br /> realistion schedule; and <br /> <br /> WHEREAS, the City has received, or is expected to receive, from each participating developer <br /> a growth management agreement, or an amendment to an existing growth <br /> management agreement, to coincide with the proposed reallocation of growth <br /> management approvals; and <br /> <br /> WHEREAS, the Modified Program has a provision concerning custom lots which prohibits <br /> custom lots from being sold until the public improvements are completed; and <br /> <br /> WHEREAS, several custom lot developers have expressed to the City that this prohibition may <br /> present a practical problem for them and staff has recommended that this part of <br /> the Program be referred to the Council Committee for further review and study; <br /> and <br /> <br /> WHEREAS, on March 1, 1994, the City Council conducted a public hearing on the proposed <br /> reallocation, as modified, at which time the Council considered the staff report <br /> and recommendations and all other relevant information; and <br /> <br /> <br />
