CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOL~ON NO. 94-27 <br /> <br /> RESOLUTION REALLOCATING GROWTH <br /> MANAGEMENT APPROVALS, AIYrHORIZING THE CITY <br /> MANAGER TO SIGN DOCUlVlENTS, INCLUDING <br /> SUBDIVISION AGREEMF~NTS, CONSISTENT WITH THE <br /> REALLOCATION, AND REFERRING TO THE COUNCIL <br /> COMMITTEE DISCUSSION CONCERNING WHEN <br /> CUSTOM LOTS MAY BE SOLD <br /> <br />WHEREAS, in 1993, the City Council made comprehensive revisions to the City's Growth <br /> Management Program including adopting Resolution No. 93-139, establishing a <br /> Modified Growth Management Allocation Program ("Modified Program"); and <br /> <br />WHEREAS, the Modified Program is a voluntary program intended to apply to all projects <br /> which have received growth management approval in 1993 or in earlier years and <br /> intended to eliminate the "backlog" of approved, but unbuilt, units by reallocating <br /> these units to future years based on the developers' good faith, best business <br /> judgment as to when building permits will be issued for units which have growth <br /> management approval; and <br /> <br />WHEREAS, the goal of the Modified Program is to have the actual units built in any year, <br /> when combined with units approved under the revised Growth Management <br /> Program ordinance, not exceed the growth rate established in the City' s General <br /> Plan; provided, however, that because the number of units which were approved <br /> for development in 1993 and prior years, but which have not yet been built, the <br /> Modified Program allows the total number of units which may be built in any <br /> year to exceed the General Plan maximum, if infrastructure is available for that <br /> level of development in the short-term; and <br /> <br />WHEREAS, under the Modified Program, the City Council in its discretion may approve the <br /> reallocation request by a developer or may modify the reallocation request in <br /> order to meet the goal of the Program, provided, however, that the Council is to <br /> give deference to a developer's initial reallocation request and is to attempt to <br /> accommodate all such requests; and <br /> <br /> WHEREAS, every developer who was eligible to participate in the Modified Program was so <br /> notified and given the opportunity to participate and of the 22 developers eligible <br /> to participate, 19 have chosen to do so; and <br /> <br /> <br />
