The granting of the variance will not be detrimental to the public <br /> health, safety, or welfare, or materially injurious to properties or <br /> improvements in the vicinity. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Denies Case AP-95-10, thereby upholding the decision of the Planning <br /> Commission and approving Case V-95-15 and Z-95-168, the application of <br /> Robert and Suzanne Earnest for a variance from the Pleasanton Municipal <br /> Code and for design review approval to allow an existing, approximately 15 <br /> foot tall open gazebo within the required front yard of a single-family lot <br /> located at 17 Foothill lane, subject to the conditions set forth in Exhibit <br /> "B", attached hereto and incorpoiated herein by this reference. <br /> <br /> Section 2: This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br /> REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON, AT A MEETING HELD ON NOVEMBER 21, 1995 BY THE <br /> FOLLOWING VOTE: <br /> <br /> AYES: Councilmembers - Dennis, Michelotti, Mohr, Pico, and Mayor Tarvet <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> ATTEST: <br /> <br /> 1 k <br /> <br /> Michael H.
