EXBIB1T A <br /> <br /> HAPPY VALLEY PRE-ANNEXATION POLICY LIST <br /> February 16, 1999 <br /> <br />The following is a draft list of major points derived primarily from the Happy Valley Specific <br />Plan which relate to the potential annexation of Happy Valley. Based upon input received at <br />previous City/Neighborhood meetings, we understand that these are generally considered to be <br />the major points which the Neighborhood would like to have included in a pre-annexation policy <br />statement of commitment from the City. It is intended that this draft document be reviewed and <br />commented on by the Neighborhood prior to submitting a final draft to the Council. Following <br />Council consideration of this document, it is expected to act upon the annexation application. <br /> <br />1. Farm Animals. The keeping of farm animals is to be permitted throughout the Happy <br /> Valley Semi-Rural Residential District on lots of at least 40,000 square feet in area in <br /> accordance with the current County standards. In addition, agricultural uses which do not <br /> conform to County standards at the time of property annexation to the City are permitted <br /> to remain as non-conforming uses subject to the provisions of Chapter 18.120 of the <br /> Pleasanton Municipal Code. <br /> <br /> In addition, the City realizes that when urban development occurs in close proximity to <br /> agricultural uses, conflicts may arise over common agricultural practices. The City <br /> recognizes that permitted agricultural pursuits conducted in accordance with good <br /> practice and maintenance are desirable and should not be deemed as a nuisance. The City <br /> further intends to maximize the protection of agricultural areas from urban encroachment <br /> by making the future owners/tenants of land within the Happy Valley Specific Plan Area <br /> aware of the nearby location and potential impacts of agricultural operations prior to <br /> moving to the area. In order to help ensure protection, the recorded deed of sale of all <br /> subdivided parcels and all property rental/lease agreements within the Plan Area will be <br /> required to include a signed statement by the future owner(s)/tenant(s) stating that they <br /> are aware of this situation. <br /> <br />2. Existing Non-Conforming Uses. Legal non-conforming businesses and home <br /> occupations existing at the time of property annexation to the City may remain in <br /> operation. However, such uses may not be expanded. <br /> <br />3 Bypass Road. A "Bypass Road" is planned to extend from the easternmost end of the <br /> future North Sycamore "East-West Collector" road, around Spotorno Hill, and terminate <br /> at the Golf Course/Spotorno Flat Area. Early construction of the Bypass Road is a high <br /> priority. Every effort will be made to complete the Road connection to the Golf <br /> Course/Spotorno Flat Area prior to the opening of the Golf Course, assuming the full <br /> length of the East-West Collector road is completed through the North Sycamore Specific <br /> Plan (NSSP) area at least one year earlier.
