June 20, 1995 <br /> Public Works Department <br /> <br />SUBJECT: 1995-96Annual Assessments for Landscape District 1984-1, <br /> Ponderosa Homes <br /> <br />STAFF RECOMMENDATION: <br /> <br /> Staff recommends the City Council adopt a resolution <br /> confirming the Engineer's Report and levying the annual <br /> assessment. <br /> <br />SUMMARY: Common area landscaping in the Ponderosa Homes <br /> subdivision is maintained through an assessment district. <br /> The maintenance is for the masonry walls, trees, <br /> shrubbery, groundcover, and irrigation systems situated <br /> on the east side of the Arroyo de la Laguna between the <br /> Arroyo del Valle and the Pleasanton Canal, and also along <br /> Paseo Santa Cruz between Corte Santa Maria and Corte <br /> Pacifica. A public hearing must be held annually to <br /> establish the assessment for the maintenance costs. <br /> <br />Honorable Mayor and Members of the Council: <br /> <br />BACKGROUND <br /> <br />On October 25, 1983, the City Council adopted Ordinance No. 1102. <br />Section 7 of this ordinance required the landscaping of narrow, <br />common strips of land which lay adjacent to the thousands of feet <br />of soundwalls within the Ponderosa Homes subdivision. A further <br />condition of this ordinance required that Ponderosa Homes enter <br />into an agreement with the City establishing how the landscaping in <br />these areas would be maintained. To accomplish this, Ponderosa <br />Homes suggested the formation of an "Assessment District," under <br />the conditions of the 1972 "Landscape and Lighting Act." Soon <br />after, the formation of Landscaping and Lighting Assessment <br />District 1984-1 was approved by the City, and since that time, <br />annual assessments have been levied to maintain the area. <br /> <br />As required by the Landscaping and Lighting Act of 1972, the City <br />must levy an annual assessment to all parcels benefitted by the <br /> <br />SR:95:196 <br /> <br /> <br />
