Resolution No. 95-37 <br />Page Two <br /> <br />WHEREAS, the City Council finds that it is in the public interest to provide the credit <br /> because the City (1) will not have to use public funds to purchase park <br /> land, (2) will not have to spend public funds to develop the park, (3) will <br /> not have to maintain the facilities once constructed, and because the <br /> neighborhood park needs of the Ruby Hill residents benefitted by the <br /> private facilities will be met; and <br /> <br />WHEREAS, the City Council further finds that the proposed private park exceeds all the <br /> applicable standards set forth in Section 19.44.090. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves the request of Signature Properties and gives a 50 % credit to <br /> Signature Properties against its requirement to dedicate land, or pay fees in <br /> lieu thereof, for Signature's providing a private 12.5 acre, fully developed <br /> neighborhood park within the Ruby Hill development, subject to the <br /> following conditions: <br /> <br /> 1. If Ruby Hill has a swim team, the swimming pool will be available <br /> for swim meets in the same manner that other swim clubs make their <br /> pools available for such meets. <br /> <br /> 2. If children from the Ruby Hill development are on soccer and/or <br /> softball teams, those teams may use the Ruby Hill fields for practice. <br /> <br /> 3. The applicant shall continue to pay the full amount of the in-lieu <br /> park dedication fee until it has paid one-half of the amount which <br /> otherwise would be due the City. <br /> <br /> <br />
