Resolution No. 95-37
Page Two

WHEREAS, the City Council finds that it is in the public interest to provide the credit
because the City (1) will not have to use public funds to purchase park
land, (2) will not have to spend public funds to develop the park, (3) will
not have to maintain the facilities once constructed, and because the
neighborhood park needs of the Ruby Hill residents benefitted by the
private facilities will be met; and

WHEREAS, the City Council further finds that the proposed private park exceeds all the
applicable standards set forth in Section 19.44.090.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON
RESOLVES AS FOLLOWS:

Section 1: Approves the request of Signature Properties and gives a 50 % credit to
Signature Properties against its requirement to dedicate land, or pay fees in
lieu thereof, for Signature's providing a private 12.5 acre, fully developed
neighborhood park within the Ruby Hill development, subject to the
following conditions:

1.
