CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 95-37 <br /> <br /> RESOLUTION UPHOLDING PARK DEDICATION FEE <br /> CREDIT FOR SIGNATURE PROPERTIES <br /> <br />WHEREAS, at its meeting of February 21, 1995, the City Council adopted Resolution <br /> No. 95-23, approving the request of Signature Properties for park <br /> dedication fee credit for providing the Ruby Hill Park; and <br /> <br />WHEREAS, the Council moved to reconsider the matter and the matter was further <br /> discussed at the meeting of April 4, 1994; <br /> <br />WHEREAS, Section 19.44.090 of the Pleasanton Municipal Code provides that in lieu <br /> of providing public recreational facilities, a developer may provide private, <br /> active recreational facilities and, under certain circumstances, may receive <br /> a partial credit for those facilities towards the developer's obligation to <br /> provide park and recreation facilities for the community; and <br /> <br />WHEREAS, at its meeting of April 4, 1995, the City Council reviewed the report of the <br /> Director of Parks and Community Services (SR 95:64), a Memorandum <br /> dated March 29, 1995 from the City Attorney concerning "Credit for Open <br /> Space", and considered comments from the applicant and other members <br /> of the public, all in connection with the request of Signature Properties for <br /> a 50% credit for providing a private 12.5 acre, fully developed, active <br /> neighborhood park for the Ruby Hill property; and <br /> <br />WHEREAS, the applicant indicated that if there is a Ruby Hill swim team, which could <br /> include members from anywhere in the City, the applicant would allow its <br /> pool to be available for swim competitions and if children from Ruby Hill <br /> are on soccer or softball teams, the teams could use the Ruby Hill fields for <br /> practice; and <br /> <br />WHEREAS, the applicant also indicated that it would continue to pay park dedication <br /> fees for units until one-half of the amount which otherwise would be due <br /> has been paid; and <br /> <br /> <br />
