B. Fire Inspector. Hazardmrs MatellaIs Coordinator and any other class assigned to a <br />2.080 hours per year schedule. <br />Any authorized time worked in excess of the employee's regular work week shall be considered <br />overtime. Overtime compensation shall be compensable at the rate of one and one -half (1.5) times <br />the employee's regular straight time rate of pay. <br />Fire Inspector and Hazardous Materials Coordinator employees have the option to accrue <br />compensatory time off in lieu of overtime at the rate of one and one -half (1.5) hours for each hour <br />worked. Upon the approval of the Fire Department, compensatory time may be accrued but the <br />total balance may not exceed fifty (50) hours at any time. <br />Compensatory time off may be taken in lieu of overtime payment in accordance with the FLSA. <br />Such time off shall be mutually agreeable: to the employee and the supervisor taking into account <br />(a) the normal schedule of work, (b) the anticipated peak hour workload based on past experience, <br />and (c) any emergency requirements for staff and services. Compensatory time off shall not be <br />taken when the employee must be replaced by another employee who would be paid at the <br />overtime rate. All accrued compensatory time off in excess of fifty (50) hours must be liquidated <br />by monetary payment. <br />C. Suppression Employees Overtime Record. <br />The Fire Department shall post the current overtime selection factor for each suppression <br />employee per the on -line records management system. <br />D. Rank - for -Rank Overtime. <br />The Authority agrees that for any absence, it will assign overtime on a rank- for -rank basis. In <br />the event that an individual of equal rank is not available to fill the position, then a pre- signed up <br />qualified actor will be used. If there is still no one available through the pre - scheduling system, <br />then mandatory overtime within the rank will be utilized. In the case of an emergency and an <br />officer and /or fire engineer is unable to be contacted, an acting assignment may be used to fill <br />these ranks. The procedures pertaining to the selection of an employee for acting officer position <br />shall be followed. (See Section 22 of this M.O.U.) <br />Section 8. Court Time <br />Employees who are required to report to work during their off - duty time for the purpose of <br />appearing in court shall be compensated at the eight (8) hour overtime rate, provided that such <br />compensation be no less than three (3) hours for court appearances in the Livermore- Pleasanton <br />Judicial District and four (4) hours for court appearances outside the Livermore- Pleasanton <br />Judicial District. <br />8 <br />
