CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 96-103 <br /> <br /> RESOLUTION APPROVING A NEGATIVE <br /> DECLARATION FOR THE APPLICATION OF DELTA <br /> PROPERTIES FOR PUD DEVELOPMENT PLAN FOR <br /> RETAIL SPACE, A HOTEL AND A RESTAURANT, AS <br /> FILED UNDER CASE PUD-96-13 <br /> <br />WHEREAS, at its meeting of September 10, 1996, the City Council received a proposed <br /> negative declaration for the application of Delta Properties for a planned <br /> unit development rezoning and development plan to construct an <br /> approximately 49,250 square foot retail center, a 126-unit hotel (66,800 <br /> square foot Candlewood Hotel), a 2,900 square foot fast food restaurant <br /> (In-n-Out Burger), and a maximum 8,500 square foot restaurant all on an <br /> approximately nine-acre site located on the northeast corner of Owens <br /> Drive and Johnson Drive, as filed under Case PUD-96-13; and <br /> <br />WHEREAS, the City Council has received and reviewed the Initial Study dated June 13, <br /> 1996, and received the recommendations of the staff and Planning <br /> Commission; and <br /> <br />WHEREAS, a duly noticed public hearing was held at which time the public was given <br /> the opportunity to comment on the environmental impacts of the proposed <br /> development plan and rezoning; and <br /> <br /> WHEREAS, the City Council has reviewed the potential impacts in accordance with the <br /> applicable state and local guidelines governing the preparation of Negative <br /> Declarations and Environmental Impact Reports; and <br /> <br /> WHEREAS, the City Council finds that the proposed development plan and rezoning <br /> would not have any significant adverse effects on the environment; and <br /> <br /> WHEREAS, the City Council further finds that the proposed project will have no <br /> potential for adverse impacts on the site's wildlife; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> <br />
