Resolution No. 96-95 <br />Page Two <br /> <br />Section 1: The bid protest of Midstate is upheld, the bid of Ralph Larsen is deemed <br /> non-responsive, and the contract for the Pleasanton Aquatic Center, Phase I, <br /> is awarded to Midstate Construction pursuant to two conditions, namely <br /> (a) staffs review and confirmation that Midstate's bid is responsive and <br /> (b) staffs confirmation that Ralph Larsen did not possess a C27 license at <br /> the time the bids were opened and/or at the time the contract was awarded. <br /> <br />Section2: The City Manager is authorized to sign a contract with Midstate <br /> Construction for the project if the conditions in Section 1 are satisfied. <br /> <br />Section 3: This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON, AT A MEETING HELD ON AUGUST 20, 1996 BY THE <br />FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Dennis, Michelotti, Mohr, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> ATTEST: <br /> <br /> Peggy E. ]~zi(ttr~, CityCClerk <br />APPROVED AS TO · ~ <br />Michael H.
