CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 96-95 <br /> <br /> RESOLUTION AWARDING THE CONTRACT FOR <br /> THE PLEASANTON AQUATIC CENTER, PHASE I, <br /> PROJECT NO. 947038, TO MIDSTATE <br /> CONSTRUCTION <br /> <br />WHEREAS, the City sent out requests for bids for the construction of the Pleasanton <br /> Aquatic Center, Phase I (Project No. 947038); and <br /> <br />WHEREAS, the specifications for the project provide, among other things, that as to the <br /> landscaping portion of the contract, the contractor must possess a State of <br /> California Landscape Contractor License, more commonly known as a C27 <br /> license; and <br /> <br />WHEREAS, the City received seven bids, including bids from Ralph Laxsen & Sons, Inc. <br /> (Ralph Laxsen) in the amount of $3,276,000, and from Midstate <br /> Construction Company (Midstate) in the amount of $3,277,323; and <br /> <br />WHEREAS, Ralph Larsen inadvertently specified two subcontractors to perform the <br /> landscaping work which, by statute, meant that Ralph Laxsen was fully <br /> qualified to perform the landscaping work; and <br /> <br />WHEREAS, Ralph Laxsen itself did not possess a C27 license when the bids for the <br /> project were opened; and <br /> <br />WHEREAS, Midstate filed a timely protest concerning the Ralph Larsen bid including <br /> that Ralph Laxsen did not possess the required C27 license; and <br /> <br />WHEREAS, on August 20, 1996, the Pleasanton City Council reviewed the bids for the <br /> project and considered the protest of Midstate; and <br /> <br />WHEREAS, on August 20, 1996, Ralph Larsen itself did not possess a C27 license. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br /> <br />
