review in such a manner that a final action would take place by no later than the end of <br /> April 1996. <br /> <br /> The PUC/Water Department will support the City's annexation of the Bernal Property, <br /> provided that the City approves a Development Application consistent with the Mutually <br /> Acceptable Plan adopted by the Committee, and that the approval is final. effective and <br /> permits an economically viable project. A development agreement will be <br /> executed to memorialize these approvals. <br /> <br />III. Alameda County. The PUC/Water Department will amend its pending County <br /> application consistent with the Mutually Acceptable Plan for a County based project. <br /> The County based project may be developed in the event the Development Application <br /> set forth in Section II above is not finally approved or effective. The County will <br /> complete its review and take a final action on the amended County application by no <br /> later than the end of April 1996.
