LETTER AGREEMENT FOR BERNAL PROPERTY <br /> MUTUALLY ACCEPTABLE PLAN <br /> AND PUBLIC REVIEW PROCESS <br /> County of Alameda + City of Pleasanton + City and County of San Francisco <br /> <br /> Adopted by the Pleasanton City Council , 1996 <br /> Adopted by the Alameda County Board of Supervisors , 1996 <br /> Adopted by the San Francisco Public Utilities Commission , 1996 <br /> <br />I. Introduction. The County of Alameda (County), the City of Pleasanton (City) and the <br /> San Francisco Public Utilities Commission acting through the San Francisco Water <br /> Department (PUC/Water Department) agreed to a cooperative planning process for the <br /> Bernal Property as set forth in Exhibit A. On December 12, 1995, the staffs from the <br /> respective public bodies presented their final joint recommendations to the Committee <br /> of Decision Makers (Committee) to affirm the acceptability of the land use program <br /> described in the attached staff report, dated December 12, 1995 attached hereto as <br /> Exhibit B, and a conceptual land plan attached hereto as Exhibit C herein collectively <br /> referred to as the "Mutually Acceptable Plan". <br /> <br /> On December 12, 1995, the Committee adopted the staff recommendation, modified to <br /> express an intent to accommodate the City's request for a total of 20 acres for <br /> community facilities to be constructed by the City on land purchased by the City from <br /> the PUC/Water Department. The staffs were directed to prepare a Letter Agreement <br /> (Agreement) for the respective public bodies to consider for approval. The Agreement <br /> would commit the County and the City to undertake an intensive and expedited public <br /> review process for a specific plan, zoning classification and development agreement <br /> concluding with a final action by no later than the end of April 1996. Outlined below <br /> are the terms and conditions of the Agreement setting forth how a separate public <br /> review process would take place in the County and the City. <br /> <br />II. City of Pleasanton. Following approval of the Agreement by the City, the PUC/Water <br /> Department will file a separate Development Application with the City for the Bernal <br /> Property based on the Mutually Acceptable Plan. The Development Application will be <br /> for a specific plan, zoning classification, zoning (PUD and a conceptual development <br /> plan), environmental review and development agreement. Reasonable costs to process <br /> and review the Development Application will be reimbursed by the PUC/Water <br /> Department following approval of the Development Application by the City. An <br /> application for a master tentative subdivision map, subdividing the Property into major <br /> development parcels, will be filed after final action on the Development Application. <br /> <br /> The public review process will begin with the filing and circulation of a Notice of <br /> Preparation of an environmental impact report (ELR) before December 31, 1995. It is <br /> anticipated the EIR analysis will be comprised of the material published in the prior <br /> draft EIR's for the Bernal Property, because the revisions to the land use program in <br /> the Mutually Acceptable Plan were devised to further mitigate environmental and public <br /> concerns. The City will process the Development Application and conduct its public <br /> <br /> <br />
