CITY COUNCrL OF THE CITY OF PLEASANTON <br /> ALAMEDA COUNTY, CALIFOKNIA <br /> RESOLUTION NO. 96-09 <br /> <br /> RESOLUTION UPHOLDING THE APPEAL OF DAN AND <br /> DOLORES GILMORE OF A DECISION OF THE PUBLIC <br /> WORKS DIRECTOR THEREBY PEILM1TrING THE <br /> REMOVAL OF A HERITAGE TREE AT 7817 FLAGSTONE <br /> DRIVE <br /> <br />WHEREAS, on December 19, 1995 the Director of Public Works denied <br /> the request of Dan and Dolores Gilmore to remove a heritage <br /> tree from their property at 78 17 Flagstone Drive; and <br /> <br />WHEREAS, Mr. and Mrs. Gilmore appealed that decision to the City <br /> Council; and <br /> <br />WHEREAS, at its meeting of Januaxy 16, 1996, the City Council held a <br /> hearing on the appeal; and <br /> <br />WHEREAS, the City Counc~ makes the following findings: <br /> <br /> 1. The tree which the Gilmores wish to remove (a 25 year <br /> old Atlas Cedar tree) is a Heritage tree by reason of its size. <br /> <br /> 2. The tree is located in the Gilmores' front yard, in the <br /> planting area, ten feet from the back of sidewalk and ten feet <br /> from the front window. <br /> <br /> 3. The needles, small twigs and other debris which fall <br /> from the tree has damaged the roof of the house by <br /> accumulating under the shingles and allowing rain water to <br /> seep in the house. <br /> <br /> 4. Pnming the tree away from the roof will not solve the <br /> problem because due to the tree's size, pruning would make <br /> the tree susceptible to toppling over in strong winds. <br /> <br /> 5. The tree, therefore, is in such a condition that it creates <br /> a threat to the safety of people and/or structures. <br /> <br /> <br />
