"Exhibit B" <br /> Conditions of Approval <br /> Case UP-95-51 <br /> City Council Case AP-95-12 <br /> <br />1. That aH improvements shall substantially conform to Exhibit "A" (floor plan), <br /> dated "Received August 18, 1995," on file with the Planning Department, except <br /> as modified by the following conditions. <br /> <br />2. That fithe operation of this use results in conflicts pertaining to parking, traffic, or <br /> other impacts, at the discretion of the Planning Director, this use permit may be <br /> submitted to the Planning Commission for subsequent review at a public hearing. <br /> If necessary, the Commission may modify or add conditions of approval to <br /> mitigate such impacts, or may revoke said use permit. <br /> <br />3. The side entrance to the secondary unit shah be eliminated and all access by the <br /> tenants to the secondary unit must be through the primary dwelling. <br /> <br />4. The applicant shall install cutoff shields on the existing side yard entryway lights <br /> to redirect the light away from the Cassens bedroom windows, or shall install new <br /> light fixtures with shields or other design features which reduce and cut off light <br /> and glare, to the satisfaction of the Planning Director. The new light fixtures or <br /> shields shall be installed within two weeks of approval of this use permit. <br /> <br />5. The applicant shall obtain all the necessary City permits to legalize the existing <br /> spa and deck. The applicant shall secure these permits within thirty (30) days <br /> from the date of project approval. The self-latehing gate around the spa shall be <br /> installed within two weeks of approval of this use permit. <br /> <br />6. That the applicant obtain all the necessary City permits for the construction of the <br /> secondary unit. <br /> <br />7. Only one residential unit on the subject property may be rented. The other unit <br /> shall be owner-occupied at all _times. With regards to the secondary unit, the unit <br /> shall be occupied by no more than two adults, although there shall be no limit on <br /> the number of children. <br /> <br />8. In no case shall the secondary unit be sold, subdivided or held under different legal <br /> ownership from the primary residence. <br /> <br /> <br />
