Resolution No. 99-02 <br />Page 4 <br /> <br />WHEREAS, the City Council finds that the applied stucco color does not meet the <br /> condition of design review approval which requires the use of a darker <br /> stucco color and does not meet the intent of the West Foothill Road <br /> Corridor Overlay District and Design Guidelines for homes in visually <br /> sensitive areas. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Denies Case AP-98-16, the appeal of Neil and Patricia Nelson to the <br /> Zoning Administrator' s and Planning Commission's determination that the <br /> applied stucco color does not meet the conditions of design review <br /> approval, and thereby denies the request of the Nelsons to allow the <br /> stucco color that has been applied to the house to remain. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON, AT A MEETING HELD ON JANUARY 5, 1999 BY THE <br />FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Ayala, Dennis, and Mayor Tarver <br />NOES: Councilmembers - Michelotti and Pico <br />ABSENT: None <br />ABSTAIN: None <br /> <br />APPROVED AS TO FORM: <br /> <br />Michael H.
