Resolution No. 99-02 <br />Page 3 <br /> <br /> elevation, the house had not had the approved color applied to it, and <br /> certain other items pertaining to the house were not completed; and <br /> <br />WHEREAS, as part of conditional temporary occupancy requirements, and in order to <br /> guarantee the completion of the exterior elevations and all outstaMing <br /> health and safety items, the Nelsons deposited certain funds in a bank <br /> account; and <br /> <br />WHEREAS, in June 1998, the Nelsons requested to use a stucco color coat on the <br /> house that was lighter than the color that had been approved for the house <br /> and which, in the City staff's view, would not be consistent with the <br /> conditions of approval; and <br /> <br />WHEREAS, the Nelsons at that time indicated that they did not like the approved color <br /> and wanted to change it; and <br /> <br />WHEREAS, the Nelsons, without receiving approval to modify the prior approved <br /> color, applied to the house a stucco color coat different (lighter) than that <br /> which had been approved; and <br /> <br />WHEREAS, the Nelsons then requested staff approval to allow the stucco color coat <br /> that had been applied to remain; and <br /> <br />WHEREAS, the Zoning Administrator determined that the applied stucco color was not <br /> consistent with the conditions of approval for the home and therefore <br /> denied the request; and <br /> <br />WHEREAS, the Nelsons appealed that decision to the Planning Commission and the <br /> Planning Commission denied the appeal, agreeing with the Zoning <br /> Administrator' s decision that the applied color was too light and did not <br /> meet the prior conditions of approval; and <br /> <br />WHEREAS, the Nelsons then appealed to the City Council the decision of the Zoning <br /> Administrator as upheld by the Planning Commission; and <br /> <br />WHEREAS, a duly noticed public hearing on the appeal was held before the City <br /> Council on January 5, 1999; and <br /> <br /> <br />
