CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RE SOLUTION NO. 9 8-13 7 <br /> <br /> RESOLUTION UPHOLDING AN APPEAL OF A DECISION <br /> OF THE PLANNING COMMISSION AND THEREBY <br /> APPROVING THE APPLICATION OF RICARDO OLIVEIRA <br /> (AP-98-13/UP-98-46) FOR A CONDITIONAL USE PERMIT <br /> <br />WHEREAS, Ricardo Oliveira applied for a conditional use permit to operate a martial arts <br /> studio in an approximately 2,400 square foot tenant space located at 148 Ray <br /> Street; and <br /> <br />WHEREAS, zoning for the property is C-C (Central Commercial) District, Core Area Overlay <br /> District, and Downtown Revitalization District; and <br /> <br />WHEREAS, the Planning Commission denied the application; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicant filed an <br /> appeal of the Planning Commission's decision; and <br /> <br />WHEREAS, a duly noticed public hearing was held before the City Council on October 20, <br /> 1998 on the appeal; and <br /> <br />WHEREAS, actions of this nature are categorically exempt from the requirements of the <br /> Califomia Environmental Quality Act (CEQA); therefore, no environmental <br /> document was prepared for this proposal; and <br /> <br />WHEREAS, the City Council makes the following findings: <br /> <br /> 1. The proposed location of the conditional use is in accordance with the <br /> objectives of the zoning ordinance and the purposes of the Districts in <br /> which the site is located. <br /> <br /> 2. The proposed location of the conditional use and the conditions under <br /> which it would be operated or maintained will not be detrimental to the <br /> public health, safety, or welfare, or materially injurious to the properties or <br /> improvements in the vicinity. <br /> <br /> <br />
