Resolution No. 98-133 <br />Page Two <br /> <br />WHEREAS, actions of this nature are categorically exempt from the requirements of the <br /> Califomia Environmental Quality Act (CEQA); therefore, no environmental <br /> document was prepared for this project. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Denies Case AP-98-07, thereby upholding the decision of the Planning <br /> Commission to approve a variance from the Municipal Code and to approve <br /> administrative design review to construct a first-story addition to the existing <br /> residence located at 5664 Paseo Navarro, with a five-foot setback from the <br /> northeastem side property line, resulting in a combined side-yard setback of ten <br /> feet where a minimum of 12 feet is the requirement, subject to the conditions listed <br /> in Exhibit "B", attached hereto and incorporated herein by this reference. <br /> <br />Section 2: The City Clerk shall forward a certified copy of this resolution to the appellant <br /> with a notice that the appellant has ninety (90) days following the date of adoption <br /> of this resolution in which to seek judicial review of this action of the City <br /> Council. <br /> <br />Section 3: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON OCTOBER 6, 1998 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers Dennis and Michelotti <br />NOES: Mayor Tarver <br />ABSENT: Councilmember Pico <br />ABSTAIN: Councilmember Ayala <br /> ATTEST: <br /> Pe~g~ .z dro, <br />A~T O <br />Michael H.
