Resolution No. 98-128 <br />Page Two' <br /> <br />Section 1: The Local Agency Formation Commission of Alameda County is hereby requested <br /> to take proceedings for the annexation of territory as described in Exhibit "A", <br /> according to the terms and conditions stated above and in the manner provided by <br /> the Cortese-Knox Local Government Reorganization Act of 1985; provided, <br /> however, that if by the time the Commission considers this application, that the <br /> pending lawsuit against the City of Pleasanton, filed by the purported owners of <br /> property identified as Parcels 116, 119 and 124 on Exhibit A, has not been <br /> dismissed with prejudice, then these parcels shall be deleted from the City's <br /> application. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON SEPTEMBER 15, 1998 BY THE FOLLOWING VOTE: <br /> <br />AYES: Cotmcilmembers - Ayala, Dennis, Michelotti, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> Peggy~E~d;'o, Cit3(JClerk <br />APPROVED AS TO ~ <br /> <br />Michael H.
