The developer shall enter into an agreement with the City, approved by the City Attorney, which guarantees that all landscaping and open space areas included in this project will be maintained at all times in a manner consistent with the approved landscape plan for this development. Said agreement shall run with the land for the duration of the existence of the structures located on the subject property. 17. The developer shall provide a bond to the City guaranteeing the installation of all landscaping and all common infrastructure improvements shown on the approved development plan or otherwise required as part of this development. The developer shall provide an itemized cost estimate of said improvements, to be submitted with the bond, for the review and approval the Planning landscaping Director prior to issuance of building permits. The bond shall be retumed to the developer upon acceptance of said improvements by the Planning Director. 18. Prior to occupancy, the landscape architect shall certify in writing to the Planning Director that the landscaping has been installed in accordance with the approved landscape and irrigation plans with respect to size, number, and species of plants and overall design concept. General Planning Conditions 19. The developer is encouraged to work with the City's Civic Arts Commission to provide public art. 20. The height of the structure shall be surveyed and verified as being in conformance with the approved building height as shown in Exhibit "A", or as otherwise conditioned.
