EXHIBIT "B" <br /> CONDITIONS OF APPROVAL <br /> Case AP-98-02 (PUD-90-19-7M) - 5568 Serenity Terrace <br /> Patel Residence <br /> May 5, 1998 <br /> <br />PERMITS and APPROVALS: <br /> <br />1. The proposed development shall conform substantially to the site plan, grading <br /> plan, architectural elevations, colorboard, and landscape plan Exhibit "A", dated <br /> "Received" March 20, 1998 on file with the Planning Department, except as <br /> modified by these conditions. Minor changes to the plans may be allowed subject <br /> to the approval of the Planning Director if found to be in substantial conformance <br /> with the approved exhibits. <br /> <br />2. The applicants shall obtain all building, encroachment, and other applicable City <br /> permits for the project prior to the conm-~cement of construction. <br /> <br />3. This design review approval will lapse within one year from the date of approval, <br /> on March 25, 1999, unless a building permit is issued and construction has <br /> commenced and is diligently pursued toward completion or a design review <br /> extension has been approved by the City. <br /> <br />4. Final inspection by the Planning Department is required prior to occupancy. <br /> <br />5. Prior to occupancy, a deed restriction, in a form approved by the City Attomey, <br /> shall be recorded against the property which specifies that the following conditions <br /> shall apply to the property and home in perpetuity: (a) the color of the home shall <br /> comply with the City Council approved Moller Ranch Custom Lot color board; (b) <br /> no additional garages or carports may be constructed in the future; (c) the pitch of <br /> the roof shall be a maximum of 5:12; (d) the height of the home shall not be <br /> increased and the north to south roof ridge shall be a maximum of 30 feet in <br /> height; (e) the covered exterior porches shall remain open and shall not be <br /> enclosed in the future; and (f) there shall be no enclosed Class I accessory <br /> structures constructed on this lot.
