I 7.5 EBDA shall have the right to access LAVWMA's monitoring station to verify <br />2 accuracy of flow measurement or to collect independent samples to verify compliance <br />3 with all applicable regulatory requirements. <br />4 7.6. In the event that the EBDA system is damaged or destroyed b.y ca. uses <br />5 beyond the responsibility of EBDA ~uch that LAVWMA flows covered 'urider this <br />6 Agreement cannot be accommodated in the EBDA system, then EBDA shall not be liable <br />7 for failure to continue to provide services described herein. <br />8 7.6. 1 EBDA will use its best efforts to repair the system and restore service <br />9 within a reasonable pedod of time. During this period of time, LAVWMA flows that cannot <br />10 be accommodated within the EBDA system shall be exempt from operation and <br />11 maintenance costs. <br />12 7.6.2 In the event that EBDA cannot restore service within a reasonable <br />13 time, the parties will negotiate in good faith to amend the terms of this Agreement. <br /> <br />14 8. LAVWMA Export Expansion Project Costs. <br /> <br />15 8.1 LAVWMA shall pay all costs of the Export Expansion Project including but <br /> <br />16 not limited to design, construction, maintenance and any costs required to connect the <br />17 Expansion Project to EBDA's system. <br />18 8.2 LAVWMA shall reimburse EBDA for all staff time and legal costs reasonably <br />19 related to the LAVWMA Export Expansion Project in accordance with the method of <br />Z0 calculating costs set forth in EXHIBIT "A". <br />Zl 9.
