EXHIBIT "B.2" <br /> <br /> CONDITIONS OF APPROVAL <br /> UP-97-27 - GREENBRIAR SYCAMORE VALLEY COMPANY <br /> SECOND-UNIT APPROVAL <br /> <br />1. Development shall be substantially as shown on the floor plans and elevations, Exhibit "A", <br /> dated "Received January 16, 1998" on file with the Planning Department, except as modified by <br /> the following conditions. Minor changes to the plans may be allowed subject to the approval of <br /> the Planning Director if found to be in substantial conformance to the approved exhibits. <br /> <br />2. This approval shall not become effective unless and until Case PUD-97-03 is approved. <br /> <br />3. Only one residential unit on any property with a primary and secondary residence may be rented. <br /> The other unit shall be owner-occupied. A second unit shall be occupied by no more than two <br /> adults, although there shall be no limit on the number of children. The developer shall indicate <br /> this condition in written form on a deed restriction to any buyer who has selected a second-unit <br /> option, and the language of this deed restriction shall be submitted to the City Attomey for <br /> review and approval prior to the issuance of building permits for any residence. <br /> <br />4. In no case shall any second unit be sold, subdivided, or held under different legal ownership from <br /> the primary residence. The developer shall indicate this condition in written form as a deed <br /> restriction to any buyer who has selected a second-unit option. The language of this deed <br /> restriction shall be submitted to the City Attorney for review and approval prior to the issuance <br /> of building permits for any residence. <br /> <br />5. One parking space shall be made continuously available to the occupant(s) of any second unit for <br /> parking. In the event that the occupant(s) of the second unit own and operate more than one <br /> auto, all vehicles shall be accommodated on-site. The developer shall indicate this condition in <br /> written form as a deed restriction to any buyer who has selected a second-unit option. The <br /> language of this deed restriction shall be submitted to the City Attorney for review and approval <br /> prior to the issuance of building permits for any residence. <br /> <br /> 6. At the time that the second unit is used as a second units, an address signs for the second unit <br /> shall be installed. Said signs shall be visible from the street, clearly indicating that two separate <br /> units exist on the parcel.
