Resolution No. 98-04 <br />Page Two <br /> <br /> B. The proposed location of the conditional use and the conditions under <br /> which it would be operated or maintained will not be detrimental to the <br /> public health, safety, or welfare, or materially injurious to the properties or <br /> improvements in the vicinity. <br /> <br /> Due to the size limitation of the secondary unit, the traffic generation <br /> should not be significantly greater than that of a single-family residence. <br /> An off-street parking space would be provided for the secondary unit. <br /> Because of the size limit of the secondary unit and the limit on the number <br /> of adults which could reside in it, there will be little or no impact on the <br /> existing sewer and utility system. The design of the secondary unit is <br /> consistent with the rural character of the NSSP area. In addition, existing <br /> and proposed landscaping on the property would provide some screening of <br /> the secondary unit from the adjacent properties. <br /> <br /> C. The proposed conditional use will comply with each of the applicable <br /> provisions of this chapter. <br /> <br /> As proposed and conditioned, the use complies with all applicable <br /> regulations of the zoning district in which the secondary unit is located. <br /> Granting a conditional use permit to Janet Burton is consistent with the <br /> City's ability to regulate zoning as listed in the Municipal Code Chapter <br /> 18.124. <br /> <br />WHEREAS, the City Council determined that the conditional use permit to establish a second <br /> unit is appropriate for the site. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br /> Section 1: Approves Case UP-97-96, the application of Janet Burton for conditional use <br /> permit approval to establish a secondary unit within the existing 800 square foot <br /> dwelling located at 570 Sycamore Road, subject to the conditions of approval <br /> shown on Exhibit "C", attached hereto and made part of this case by reference. <br /> <br /> Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> <br />
