Resolution No. 97-140 <br />Page Two <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Denies the appeal of Mr. and Mrs. Battershell, thereby upholding the decision of <br /> the Planning Commission to approve design review of a child's play stntcture <br /> located at 6719 Cone Santa Maria, subject to the conditions listed in Exhibit "B", <br /> attached hereto and made a part of this case by reference. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br />Section 3: The City Clerk shall forward a certified copy of this resolution to the appellant <br /> with a notice that the appellant has ninety (90) days following the date of adoption <br /> of this resolution in which to seek judicial review of this action of the City <br /> Council. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON DECEMBER 2, 1997 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Dennis, Pico, and Mayor Tarver <br />NOES: Councilmembers - Ayala and Michelotti <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> Pe~l~&o, Cffy'~Clerl~ <br />AP~~7~F~~..~ <br />Michael H.
