CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 97-140 <br /> <br /> RESOLUTION DENYING THE APPEAL AND THEREBY <br /> UPHOLDING THE DECISION OF THE PLANNING <br /> COMMISSION TO APPROVE THE APPLICATION OF JOE <br /> BROYER FOR DESIGN REVIEW OF A PLAY STRUCTURE <br /> (AP-97-08/Z-97-127) <br /> <br />WHEREAS, the Zoning Administrator conditionally approved Case Z-97-127, the application <br /> of Joe Broyer for administrative design review of a child's play structure located at <br /> 6719 Corte Santa Maria; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicant filed an <br /> appeal conceming certain conditions of approval; and <br /> <br />WHEREAS, zoning for the property is Planned Unit Development (PUD) - Medium Density <br /> Residential (MDR) District; and <br /> <br />WHEREAS, at its duly noticed public hearing on October 8, 1997, the Planning Commission <br /> considered all public testimony, relevant exhibits, and recommendations of the <br /> City staff concerning this application; and <br /> <br />WHEREAS, the Planning Commission determined that the child's play structure, as <br /> conditioned, is appropriate for the site; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the Planning <br /> Commission decision was appealed by Julie and Steve Battershell; and <br /> <br />WHEREAS, a duly noticed public hearing on the appeal was held before the City Council on <br /> December 2, 1997; and <br /> <br />WHEREAS, the City Council finds that the child's play structure, as conditioned, is appropriate <br /> for the site. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br /> California Environmental Quality Act (CEQA); therefore no environmental <br /> document was prepared for this project; and <br /> <br /> <br />
