"1 9.1.3 To employ and retain consultants, contractors, agents and employees 2 and to establish compensation, salaries and other benefits for such 3 persons as are necessary to implement this Agreement. 4 9.1.4 To sue and be sued. 5 9.1.5 To acquire, hold, and dispose of property, including the power to 6 acquire property by eminent domain. 7 9.1.6 To prepare and adopt a general budget for LAVWMA's functions. 8 9.1.7 To receive, accept, and expend or disburse monies by contract or 9 otherwise for purposes consistent with the provisions hereof, which 10 monies may be provided by the United States Government, the State of 11 California, or any subdivision thereof, or received from any other 12 person, agency, or organization, whether public or private, for the 13 purposes specified herein. LAVWMA shall maintain at all times a 14 complete and accurate system of accounting for said monies. 15 9.1.8 To receive, accept, and utilize the services of personnel offered by any 16 of the Member Agencies, or their representatives or agents; receive, 17 accept, and utilize property, real or personal from any of the Member 18 Agencies, or their agents or representatives. 19 9.1.9 To incur debts, liabilities and obligations in order to carry out the pur- 20 poses of this Agreement including incurring administrative expenses. 21 Such power includes the power to issue revenue bonds pursuant to 22 Government Code Section 6540, et seq., Section 6584 et seq., and the 23 Revenue Bond Law of 1941 (Government Code Section 54300, et seq.), 24 or any other then-available law, in order to carry out projects 25 undertaken pursuant to this Agreement. 26 9.1.10 To insure itself and the Member Agencies from loss, liability, and 27 claims arising out of or in any way connected with the performance of 28 this Agreement. 29 9.1.11 To exercise any power common to the Member Agencies hereto and to 30 advise the Member Agencies in the exercise of individual powers 31 possessed by said Member Agencies, provided that said powers are 32 exercised in furtherance of the purposes of this Agreement. 33 9.2 Manner of Exercise of Powers. As to those powers vested in LAVWMA 34 pursuant to Section 6508 of the Government Code and this Agreement, 35 unless otherwise specified by this Agreement or by rules and regulations 36 adopted by the Board, such powers shall be exercised in the same manner and 37 subject to the same restrictions as to those applicable to the City of Pleasanton 38 pursuant to the statutes and laws of the State of California.
