5. Tow ServiCe Unlawful Acts (12110). "(a) Except as <br /> provided in subdivision (b), no towing service shall <br /> provide and no person or public entity shall accept <br /> any direct or indirect commission, gift, or any <br /> compensation whatever from a towing service in <br />.. consideration of arranging or requesting the <br /> services of a tow truck. As used in this section, <br /> "arranging" does not include the activities of <br /> employees or principals of a provider of towing <br /> services in responding to a request for towing <br /> services." <br /> <br /> 6. StODDina or Darkina (22513). Section 22513 <br /> prohibits a tow truck operator or owner from <br /> stopping at the scene of an accident or near a <br /> disabled vehicle for the purpose of soliciting an <br /> engagement for services, or furnishing any towing <br /> services unless summoned to that accident scene or <br /> disabled vehicle, or flagged down by the owner or <br /> operator of the disabled vehicle or by a peace <br /> officer. The tow truck driver or owner is also <br /> prohibited from removing any vehicle from a highway <br /> or public property, without the express written <br /> authorization of the vehicle's owner or operator, or <br /> a law enforcement officer or agency, when the <br /> vehicle has been left unattended or when there is an <br /> injury as a result of an accident. <br /> <br /> 7. StODDinq On Freeway (22520). "No person shall stop, <br /> park, or leave standing any vehicle upon a freeway <br /> which has full control of access and no crossings at <br /> grade except: <br /> <br /> a. When necessary to avoid injury or damage to <br /> persons or property. <br /> <br /> b. When required by law or in obedience to a peace <br /> officer or official traffic control device. <br /> <br /> c. Any person actually engaged in maintenance or <br /> construction on freeway property or any <br /> employee of a public agency actually engaged in <br /> the performance of official duties. <br /> <br /> d. Any vehicle which is so disabled that it is <br /> impossible to avoid temporarily stopping and <br /> any vehicle which has been summoned to render <br /> assistance to a vehicle or person, including a <br /> vehicle owned by the donor of free emergency <br /> assistance, which has been summoned by display <br /> upon or within a disabled vehicle of a placard <br /> <br /> -B 5- <br /> <br /> <br />
