Staff recon~xmendcd that the <br />Planning Commission approve this application~ <br />In response to an inquiry by G'ommissioner Roberts regarding whether the Firc <br />Department had any concern about a warm tar kettle near the propane storage, <br />Ms. Decker replied that there were no concerns to her knowledge- She added that all tar <br />kettles are required to be turned off and cold before being stored at the subject site. <br />In response to an inquiry by Clonmzissioner Pox regarding whether a tar kettle was the <br />same thing as a tar pot, Mr. Fiala confirmed that they were the same. <br />In response to an inquiry by Commissioner Fox regarding staff s opinion about the <br />proximity to the Quarry Lane School, Ms_ Dceker replied that staff did not have concerns <br />related to that issue- The tar pots would be cold when stored- <br />In response to an inquiry by Clommissioner Blank regarding the tcxrxperature of the tar <br />below which odors would not amen ate, Ms. Decker replied that the intent was that the <br />fumes from heating the kettles would not be discernable by the neighbors. <br />THE PUBLIC HEARING WAS OPENED- <br />Jeff Antrim, Antrim Engineering and Construction, representing the investment group, <br />noted that he had been the occupant of the building for 13 years- Mr_ Fiala had indicated <br />that he agreed with all the conditions in Attachment I3, except for the Condition No. 20, <br />which was brought forth at this meeting in staiPs memo to the C7ommission_ F Ic noted <br />that Conditions No. 7 4 was not applicable and that Bay Area Air Quality Management <br />District regulated the manufacturer of roofing materials, not the contractors- He <br />recoxrxmanded that this condition be removed. Regarding Condition No_ 6, he noted that <br />the Fire Marshall has already approved the applicant. He noted that CGonditions Nos. 7 <br />and 8 were being addressed already. He advised that the applicant did not plan to store <br />many n~xaterials outside and. that he planned to move to Pleasanton to add refilective white <br />roofing n~x aterials suitable for green building~_ I lc added that some items would be <br />stored outside tcrnporarily but that they would be screened by the fence- He rey uested <br />that Condition No_ 20 be removed- He added that 475°F was considered to be hot and <br />was the boiling point of the tar. The tar would stop smoldering at 400"F and added that it <br />would not be off gassing by the time it was stored at their yard. <br />Frank Fiala, applicant, described the physical properties of the tar as it smolders and then <br />cools. A discussion of the contractor's treatment of tar of various temperatures ensued. <br />Mr. Fiala rioted that he did most of the whites reIIective rooting in his recent work and <br />added that he had done only three jobs with the kettle in 2005. <br />PLANNING COMMISSION MINUTES December 14, 2005 Page 10 of 18 <br />
