Coirimissioner Roberts noted that any neighbor may niakc calls to the Bay Area Air <br />Quality Board if the smell from the tar kettles was noticeable- <br />Mr_ Fiala noted that he would agree to leave the tar kettles on the job site cmtil they ware <br />cooled before bringing them back to his site. <br />THF_ PUBLIC HEARING WAS CLOSED_ <br />A discussion of the conditions and the CCc4cRs ensued. Ms. Decker advised that the City <br />did not involve itself in enforcing CCBcRs. <br />Commissioner Blank suggested that because Conditions Nos_ 20 and 21 were covered by <br />the CCBcRs, they be retrioved from the conditions of approval. <br />Chairperson Maas requested that staff- work with the applicant regarding Condition E. <br />C'otnrnissioner Fox noted that she was concerned about the odor from the tar kettle with <br />respect to their proximity to the residences near Orloff Park as well as to the Quarry Lane <br />School. She was also concerned about the outdoor storage of the materials. <br />Commissioner Blank moved to make the required conditional use findings as listed <br />in the staff report and to approve Case PCUP-146 subject to the conditions of <br />approval listed in Exhibit S, as recommended by staff, with the modifications that <br />Conditions Nos_ 20 and 21, shown on the staff memo dated December 14, 2005, be <br />deleted and that the phrase "if necessary" be added at the end of Conditions Nos_ 6 <br />and 14 regarding the provision of a Hazardous Material Management Plan and the <br />Kay Area Air C2uality Management District approval for the use of the tar kettles, <br />respectivcly_ <br />Commissioner Arkin seconded the motion_ <br />ROLL CALL VOTE. <br />AVES: Commissioners Arkin, Blartlc, Maas, and Roberts- <br />NOES: Commissioner Fox. <br />ABSTAIN: None. <br />RECUSED: None. <br />ABSENT= None_ <br />Resolution No. PC-2005-67 was entered and adopted as motioned. <br />The Planning Commission recessed for a break ai 9:04 p.m. <br />Chairpersoi~ Maas reconvened the meeting at 9: 7 4 p.m. <br />PLANNING COMMISSION MINUTES December 14, 2005 Page 1 7 of 1 K <br /> <br />
