an intersection and the C=ity has identi Pied a mitigation measure, it is the responsibility of that <br />applicant to implexneat that measure_ <br />Commissioner nrkin expressed concern. about adding another traffic light and suggested a <br />left-turn lane instead to control traffc_ <br />G'ommissioner Roberts noted. that the location of the Fire Department could necessitate a traffic <br />light_ <br />Mr_ Grubstick agreed with Commissioner Roberts' assessment that this particular intersection <br />was adjacent to the Fire Station and that the Fire Department has expressed concern about being <br />able to control this intersection; the best way to control it is by using a traffic signal. <br />Commissioner Arkin. suggested that the traffic signal be turned to red whenever the Fire <br />Depariti~ent rey aired it. <br />Commissioner Blank noted that he drove this route daily and was surprised by the <br />recommendation for a signal He recalled that the Commission had requested that staff provide a <br />list of specific uses and he was surprised by the inclusion of adult entertainment establishments. <br />Because of the traffic concerns, they had preferred uses that had minimal traffic impacts, and he <br />was surprised to see the inclusion of drive-through restaurants_ <br />Mr_ Pavan noted that this list contained uses permitted by right in the C7-S District_ 1Iowever, <br />there was considerable locations] criteria establish cd in the Municipal Code for adult <br />entertainment and noted that there was a synagogue ncarby_ <br />In response to an inquiry by Commissioner Slank whether the 1. ist could be restricted. further by <br />the Con~niission, Mr_ Pavan confirmed that could not be done at this time_ The listed uses do not <br />require conditional use permits; the Stanley Business Park PUD took certain conditionally <br />allowed uses of the C-S district, such as automotive repair, and elevated them to permitted uses. <br />He noted that drive-through restaurants generally had a very high trip generation rate; however, <br />this site, as presently proposed, is not configured to accommodate adrive-through restaurat~t. If <br />an applicant requested one, it would raise design questions sad require Planning Commission <br />approval. The high trip rates oI a drive-Ebro ugh restaurant would also raise questions about the <br />consistency with the trafi-ic analysis and the Initial Study and Negative Declaration_ He believed <br />that a drive-through restaurant would require a new negative declaration, traffic analysis, and <br />public bearing. He noted that the iral~ic signal would be req aired. <br />Ms_ Nerland explained the Level of Service determination and noted that this application was a <br />design review, not a PUD anzendment_ She noted that the applicants were not bound to the uses <br />that they were likely to have. <br />Ms. Decker noted that in discussions with the Traffic Engineer, the uses dePned within this PUD <br />a~zd those that are under consideration change the LOS such that the traffic signal is required as <br />part of-the project to mitigate the in~pacts_ As the condition is currently phrased, it Heads to be <br />operational at the first occupancy, not From the issuance of building permits.
