Commissioner Arkin moved to deny PDUP-8, based on the fact that the conditional <br />use permit findings could not be made due to the high density of the area; the site is <br />not asingle-family residential-zoned lot but a smaller lot zoned PUD-high density <br />residential; the use would generate more traffic; th¢ sit¢ is on a narrow, long looped <br />private street with a blind corner which would create safety issues, and the nature <br />of th¢ privat¢ street creates an enforceability issue with regard to traffic problems~ <br />Commissioner Roberts seconded the motion- <br />Commissioner Blank. noted that he was less concerned with the size of the lot than the <br />traffic, safety, and enforceability issues. <br />Commissioner Fox stated she would not support the motion and believed this home <br />would be suitable for a large family day care- She believed the precedent was set by the <br />City having approved. large family day cares in multi-family residences with smaller than <br />3,500 square feet lots and cited Stone Pointe Way as an example- She noted that Stone <br />Pointe Way was a curved area with smaller sized streets as well. She expressed a bit ol~ <br />concern about enforceability of traffic violations but believed that since Hacienda <br />Security has a security database, and James Paxson had indicated that each security issue <br />is reported to the City's Police Department, it would be easy to manage the conditional <br />use permit. <br />Commissioner Pearce noted that Ms_ Nerland's memo stated that there was a way to <br />enforce the traffic code if the people who live there so desire. The residents may petition <br />the City Council, and the Council may direct the street to be treated like a public street- <br />She was struck by the fact that if the residents were so concerned that the 2,000 trips per <br />day generated a lot of speeders, the residents may take it upon themselves to bring this <br />issue to the City Council.
