6_ PUBLIC HEARINGS AND OTHER MATTERS <br />a. PDUP-8. Vilas c4c Me~ha Thuse <br />Application for conditional use permit approval to expand an existing small <br />family daycare facility into a large family daycare facility of up to 14 children at <br />5276 Genovesio Drive. Zoning for the property is PUD-HDR Planned Unit <br />Development -High Density Residential District- <br />Ms. Decker summarized the staff report and described the layout and scope oI-this <br />application- She noted that large-family daycare applications generally go through the <br />Zoning Administrator approval process, but because a significant number of comments <br />from the neighboring residents had been received, a Planning Commission hearing was <br />deemed to be a more appropri etc forum. She noted that the daycare had the appearance <br />of asingle-family detached residential development; the density of the area was <br />approximately eight dwelling units per acre for the entire development. The subject area <br />was glower-density area than most of the development- Shc displayed an overhead map <br />of the neighborhood, including the location of the residence and various features of that <br />area of the development- She noted that the open space play area was vary close to the <br />applicants' residence_ <br />Ms_ Decker noted that staff examined this application with respect to the four areas of <br />traffic, parking, safety, and noise and how the development meets and mitigates any <br />concerns- The project was noticed to owners and residents within a 1,000-foot radius of <br />the site, and significant correspondence was received. Most of the comments received <br />were in response to how to remedy traffic and parking impacts. Staff noted that there <br />were constraints to the site but that conditions of approval were crafted to mitigate those <br />constraints. Staff included a condition that the driveway be used as the pick-up and <br />drop-off point In order to approve this application, the Planning Commission must make <br />the Endings For the conditional use permit that it is in accordance with the objectives of <br />the zoning code and the purpose of the district in which it is located, that the proposed <br />location of the conditional use would be maintained would not he detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or improvements <br />in the vicinity; and that the proposed use will comply with each of the applicable <br />provisions of the municipal code_ <br />Ms_ Decker noted that this was a very sensitive project item and had been continued in <br />order to investigate additional information. Staff spoke with the Child Care Law C7enter <br />to examine how the City conditioned. these kinds of projects with respect to those four <br />areas- It was found that related to those concerns, the conditions imposed by the City <br />ware rcasonable_ <br />Staff believed the impacts of the proposed project were mitigated by the conditions set <br />forth and recommended that the Planning Co~rtmission approve this application. <br />In response to an inquiry by Commissioner Roberts about using an area down the street <br />for pick-up and drop-off Ms_ Decker replied that it was a private street and noted that <br />PLANNING COMMISSION MINUTES July 13, 2005 Page 3 of 15 <br />
