c_ PCUP-145. Chris Beratlis and Kazuo Hats ushi <br />Application For a conditional use penriit to allow temporary stockpiling of <br />approximately 10,000 cubic yards of excess dirt material from the Beratlis <br />property located at 10 Beratlis Place onto the Hatsushi nursery property located at <br />2798 Vineyard Avenue- Zoning for the property is PUD-LDR/OS ~Plarcned Unit <br />Development -Low Density Residential/Open Spaced District~ <br />Ms. Decker summarized the staff report and described the history and scope of this <br />application. She noted that efforts were made to make the placement of the dirt look <br />natural and that it would not be a visual blight- She advised that an e-iriail containing <br />concerns was received from Mr_ Lloyd, who resides at the Montevino address- this e-mail <br />was forwarded to the Planning Commission_ The response from. the project phan ner, <br />Marion Pavan, containing apoint-by-point response, was also forwarded to the Planning <br />Commission_ Staff recommended approval of this item. <br />THE PUBLIC HEARING WAS OP ENED_ <br />Chris Beratlis, applicant, 10 Beratlis Ylace, distributed material to the Plam-cing <br />Commission that reflected the comments made by over 60 neighbors he had contacted. <br />H.c generally concurred with the staff report- With respect to Condition No_ 7, regarding <br />the trees, he would prefer achain-link fence around each tree versus a $5000 bond for a. <br />year to protect the trees against damage. He believed that being required to do both was <br />redundant- He noted that Mr_ Lloyd wanted assurances that his home would not be <br />damaged- He contracted with a home inspection service to inspect Mr_ Lloyd's home <br />before the project began, including the foundation, swimming pool, and fence. After <br />completion of the construction, he would reinspect the home and take care of any damage <br />that might have occurred- Ha was confident that there would not be any damage and was <br />happy to put Mr. Lloyd's mind at ease. <br />Ralph D. Hughes, 4471 Stoneridge Drive, Mr_ Hatsushi's son-in-law, noted that he would <br />be impacted by the planned development and the grading. He expressed concern about <br />erosion and believed the C'ity's approach to this issue was excellent. <br />In response to an inquiry by Commissioner Roberts regarding C7ondition No_ 1 O, the <br />requirement to pay all applicable fees prior to the issuance of a building permit, <br />Ms_ Decker conFirmed that was a standard condition placed on all projects and that it was <br />understood that Mr_ Beratlis would pay all the fees that the property would be subject to_ <br />Michael Aminian, 865 CGl era Lane, spoke in support of this item and added that the <br />applicant had shared the project plans with him- He noted that he had no interest in the <br />applicant's property. <br />Darryl Alexander, project consultant, ] 47 Old Bernal Avenue, noted that he would be <br />available to answer any technical questions. <br />PLANNING COMMISSION MINUTES July 13, 2005 Page 10 of 15 <br />
