THE PUBLIC HEARING WAS OPENED. <br />Suman Trivedi, applicant, 770 St. Michael Circle, addressed the Co~sirrtission requesting <br />that her appeal be upheld- Mr_ Jaypaul "I'rivedi indicated that they had had such <br />overwhelming support for their business that they wished to expand it to help serve their <br />current customers, that he had recently been undergoing a change in exi-xployment and so <br />it would be likely that he would be the employee for the increased number of children, <br />and. therefore, the additional parking for art employee would not ba needed, and that they <br />were willing to restrict the number of children to 1 O instead of 14. Mr_ Trivedi also noted <br />that they were willing to work with staff to devise some way of finding a way to mitigate <br />the parking issues. He also stated that one of the spaces directly in front of his home was <br />currently being used by his eldest son who would be going to college shortly and. <br />Therefore- could be used by clients. He also stated that it was reasonable to use the guest <br />parking spaces, and that the children are dropped oFF at staggered times- <br />Jacquie Dynes, Community Association Manager, representing the Vintage "harrace <br />Townhouse Homeowners Association, spoke and represented to the Commission the <br />Homeowners Association's desire that the Zoning Administrator's decision be upheld for <br />the reasons outlined in the staff presentation. Additionally, although not a concern of the <br />Commission but greatly to the Association was the issue oFliability. Ms. Dynes outlined <br />both the State and the Homeowners Association insurance requirements for bonding that <br />the applicant had not met to date although it is also required for the currant daycare <br />operations. Ms. Dynes indicated that the applicant had been unresponsive and unwilling <br />to provide verification in meeting those requirerents_ She closed by requesting that the <br />appeal be denied. <br />John Rodriguez, 724 St. Michael Circle, spoke in opposition to the request for the <br />expansion of the small family daycare because the increase in the number of children <br />would impact his ability to enjoy his home- <br />THE PUBLIC HEARING WAS CLOSED. <br />Commissioner Roberts indicated that she had driven through the complex. She stated <br />that she found the place to be extremely crowded axed felt that an expansion of the <br />daycare Facility would be a burden to the other residents- She expressed concern about <br />the adequacy of parking spaces and concurred with the Pire Department's assessment <br />regarding safety issues. <br />Commissioner Blank expressed concern regarding traffic and safety of the access. He <br />further indicated that he could not envision a large family daycare facility at the site, <br />given the physical layout of the complex. <br />Commissioner Roberts moved to deny the appeal, Case PAP-73 (PDUP-6), as <br />recommended in the staff report. <br />G'ommissioner Maas seconded the motion. <br />PLANNING COMMISSION MINUTES March 9, 2005 Page 3 of 1 O <br />
