-~- advised that the next lease would contain a use clause that pertained to the use permit as <br />applicable to the property. <br />In response to an inquiry by Chairperson Maas whether he would be agreeable to the <br />conditions, Mr_ Straface confirmed that he would be agreeable, as long as they were <br />reasonable, similar to other properties in the City, and provided they did not ask a <br />property owner to make improvements for other properties~ <br />In response to an inquiry by Commissioner Blank whether the eviction process had <br />passed the point where the owner of the Union Jack Pub may fight the eviction in court, <br />Mr_ Straface confrmed that was the case- <br />Christine Salidivar, Pleasanton Downtown Association, 830 Main Street Suite A, noted <br />that it was unfortunate that the Union Jack Pub had not taken the necessary steps to be a <br />good neighbor and mitigate the problems raised by the neighbors- After reviewing the <br />conditional use permit, she believed that the Union Jack Pub had not been in compliance <br />for some time- She preferred to deal with the current problems and not "poison" the <br />property for future tenants; she complimented staff on the addition of the conditions that <br />would take that issue into consideration- The Pleasanton Downtown Association fully <br />supported staff s recommendations. <br />Joe Yoon, 3707 Mt Diablo Boulevard, Lafayette, noted that he ran a re staurant/bar <br />~Joe's~ in Lafayette and added that he previously worked at the Union Jack Pub for four <br />years. He had been briefed on the problems at Joe's regarding patrons and some <br />troublesome staff- His first action was to change the closing hours to midnight during the <br />week, and 1 =00 a_m_ on weekends; he noted that dissipated a lot of the problem. elements- <br />He noted that patrons of bars that closed earlier would come to the Union Jack Pub and <br />continue drinking- He added that the bartenders did not monitor alcohol intake that late <br />at night, which caused further problems. He noted that he was in the process of trying to <br />obtain the Union Jack Pub, with the intent of turning it into a jazz club as he did in <br />Lafayette. He added that he had taken his bartenders to ABC meetings for training <br />Se SS10nS_ <br />Chris Beratlis, 351-C St_ Mary Street, expressed concern about the Union Jack Pub's <br />operations- He distributed photos taken from his parking lot at 347 St_ Mary Street- He <br />had spoken with Mr. Straface and the Code Enforcement Officer numerous times about <br />his fence, which had been kicked down numerous times. <br />Chairperson Maas noted that staff had recommended a chain lir~k fence. <br />Mr. Beratlis noted that if the fence were built to CalTrans specifications, it might hold up. <br />He noted that the conditions in the parking lot were unbearable due to the vandalism, <br />urination, and defecation by some of the patrons. <br />PLANNING COMMISSION MINUTES February 23, 2005 Page 6 of 17 <br />
