Thursday to 1 1 :00 a.m. - 1 1 :00 p.m., and from 1 1 :00 a.m. to midnight on Friday and <br />Saturday _ <br />Regarding the issue of controlling the activities of the patrons, staff believed it would be <br />beneficial that the owner engage the services of security personnel; uniformed security <br />personnel is not necessary if a bouncer is used. Staff believed it would be beneficial to <br />require the business owner to clean the surrounding area for a certain distance to mitigate <br />the debris problems that affected the adjacent business owners. Conditions 6 and 7 <br />addressed the use of the outdoor patio for dining only. Damage has also been effected on <br />adjacent property owners by the throwing of debris, bottles, cigarettes remains, and <br />damage on the fence. Regarding smoking, the business must comply with Chapter 924 <br />of the Municipal Code. She advised that page 8 contained a typo: the second listed <br />Condition 9, addressing compliance with the ABC regulations, should be listed as <br />Condition 10. <br />Staff recommended that the Planning Commission discuss this issue, make the findings <br />as indicated on page 9 of the staff report, and adopt a resolution to either: <br />1 _ leave the conditions as they were stated per the 1988 use permit; <br />2. implement the recommended conditions per staff's recommendations; <br />3 _ amend staff s recommended conditions; <br />4. suspend the use permit; or <br />5. revoke the use permit. <br />Ms. Decker stated that although it is not shown or reflected in the staff report, the <br />Commission may amend the use permit such that this establishment may be subject to <br />one year £or performance measure. The owner may come back before the Commission <br />for review performance so that they may have the opportunity to perform under the <br />conditions. <br />In response to an inquiry by Commissioner Roberts regarding the meaning of use permit <br />suspension, Ms. Nerland conf rmed that the use permit may be suspended for a time <br />period so that any egregious activities may be mitigated, after which the business may <br />re-open. The use permit does not need to be suspended before it may be revoked. <br />In response to an inquiry by Chairperson Maas regarding the operational status of the <br />business, Ms. Decker contrmed that the business is currently closed for reasons other <br />than the Planning Commission's actions. <br />In response to an inquiry by Chairperson Maas regarding the hours of operation For the <br />Crown Pub, Ms. Decker confirmed that the closing times were midnight on weekdays, <br />and 1 :00 a.m. on weekends. She added that the hours of operation for the Union Jack <br />Pub were fashioned after those of the Crown Pub, and then reduced. <br />In response to an inquiry by Commissioner Fox regarding a similar number of police <br />calls for the Popi Lounge and the crime management for that area of town, Lt.
