<br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 06-010 <br /> <br />RESOLUTION APPROVING THE APPEAL OF CASE PAP-85, THEREBY <br />OVERTURNING THE PLANNING COMMISSION DENIAL OF THE <br />APPLICA nON OF VILAS AND MEGHA THUSE FOR CONDITIONAL <br />USE PERMIT, AS FILED UNDER CASE PDUP-8 <br /> <br />WHEREAS, Vilas and Megha Thuse have applied for a conditional use permit to expand <br />an existing small family daycare home into a large family daycare home for <br />up to II children at 5276 Genovesio Drive; and <br /> <br />WHEREAS, zoning for the property is PUD-HDR (Planned Unit Development - High <br />Density Residential) District; and <br /> <br />WHEREAS, at its meeting of August 10, 2005, the Planning Commission, after having <br />considered all public testimony, relevant exhibits, and recommendations of <br />City staff concerning this application, denied the application; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicants <br />submitted an appeal to the decision of the Planning Commission; and <br /> <br />WHEREAS, at its meeting of February 7, 2006, the City Council received a report from <br />the Director of Planning and Community Development, together with a <br />copy of the staff report to the Planning Commission, regarding this matter; <br />and <br /> <br />WHEREAS, the City Council held a public hearing on February 7, 2006, at which time <br />the applicants and any other member of the public were offered an <br />opportunity to present evidence regarding this appeal; and <br /> <br />WHEREAS, after a review of the materials presented, the City Council determined that <br />the proposed conditional use, as conditioned, is appropriate for the site and <br />is consistent with the zoning regulations for the zoning district of the <br />property. <br />
