CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 06-010 RESOLUTION APPROVING THE APPEAL OF CASE PAP-85, THEREBY OVERTURNING THE PLANNING COMMISSION DENIAL OF THE APPLICA nON OF VILAS AND MEGHA THUSE FOR CONDITIONAL USE PERMIT, AS FILED UNDER CASE PDUP-8 WHEREAS, Vilas and Megha Thuse have applied for a conditional use permit to expand an existing small family daycare home into a large family daycare home for up to II children at 5276 Genovesio Drive; and WHEREAS, zoning for the property is PUD-HDR (Planned Unit Development - High Density Residential) District; and WHEREAS, at its meeting of August 10, 2005, the Planning Commission, after having considered all public testimony, relevant exhibits, and recommendations of City staff concerning this application, denied the application; and WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicants submitted an appeal to the decision of the Planning Commission; and WHEREAS, at its meeting of February 7, 2006, the City Council received a report from the Director of Planning and Community Development, together with a copy of the staff report to the Planning Commission, regarding this matter; and WHEREAS, the City Council held a public hearing on February 7, 2006, at which time the applicants and any other member of the public were offered an opportunity to present evidence regarding this appeal; and WHEREAS, after a review of the materials presented, the City Council determined that the proposed conditional use, as conditioned, is appropriate for the site and is consistent with the zoning regulations for the zoning district of the property.
