PC-2005-61 <br />RESOLUTION APV ROVING A CONDi7'lONAL USE PERMIT FOR FRANK FIALA, <br />PRANK FIALA ROOF}NG, fNC_, AS FiL~ED UNDER CASE PCUP-146 <br />WHEREAS, Frank Fiala, Frank Fiala Roofing, Ine_, has applied for a conditional use permit to <br />operate a roof contractor's business at 1228 Quarry Lane, Suite C- and <br />WHEREAS, zoning for the property is PUD-f (Planned Unit Devclopnzent Industri alb <br />District; and <br />WHEREAS, at its duly noticed public hearing of December 1 4, 2005, the Planning <br />Commission considered al] public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act <CEQ A~; and <br />WHEREAS, the Planning Commission made the following findingsc <br />The proposed location of the conditional use is in accordance with the <br />o}~jectives of the zoning ordinance at~d the purpose of the district in which <br />the site is located- <br />'I'hc objectives of the zoning ordinance include fostering a harmonious, <br />convenient, workable relationship among land uses; protecting existing land use <br />from inharmonious influences and harmful intrusions; and ensuring that public <br />and private lands ultimately are used for the purposes which are most appropriate <br />and beneficial to the City as a whole. The roofing company would be operated <br />primarily within the existing building. With the restriction of hours of operation <br />for the warehousing/outdoor storage activities, the proposed use would be <br />operated in such a. manner that it would conform to the YUL7-P30-U1 and would <br />result in mini n~al disturbance to the nearby businesses and residents- The <br />proposed used would be a ec»r,patible use: in the building- <br />The subject site is in the Valley Business Park, a business park that is dominated <br />by businesses that involve office/warehousing. As conditioned, the proposed <br />rooting contractor's business will not generate any unusual de~z~ands on the <br />existing parking for the subject site or the surrounding properties. In addition, the <br />condition of the approval requires the applicant to mitigate any nuisances that <br />may occur as a result of the proposed business. Therefore, this 1-ending can be <br />made. <br />
