Resolution No. YC-2005-60 <br />Page Two <br />the surrounding businesses and surrounding properties_ Therefore, this finding <br />caxi be n-xadc. <br />2_ The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br />The: proposed. music studio is small in scale, and its teaching is based on <br />electronic piano with volume control. Based on the proposal, its operation would <br />be corrxpati ble with other uses in the shopping center, as it would be confined <br />inside the building and as its soundproofing would be added to the common wall <br />shared by another tenant. In addition, the subject facility is approximately <br />200 feet From the nearest residenti al property to the south and is separated from <br />the residential neighborhood by a parking lot and a masonry wall. The noise and <br />trai-fie generated from the proposed tutoring center should not impact the <br />residential neighborhood. Additionally, adeq uatc and safe ingress and egress into <br />and out of the site and sufficient on-site parking would make the proposed use <br />suitable for the subject site_ Therefore, this finding can he xr~ade. <br />"I'he proposed conditional use will comp}y with each oP the applicable <br />provisions of the Goring Ordinaiice_ <br />The site's zoning regulations conditionally permit the establishn-xent of similar use <br />to a tutoring facility_ "i'he proposed use complies with all relevant sections of the <br />zoning ordinance. Granting a conditional use permit to the applicant for a music <br />studio would be consistent with the City's ability to regulate zoning as listed in <br />the Municipal Codc.
