PLANNING COMMISSION CITY OF YI_EASAN'rON <br />ALAMEDA COiJNTY, CALIFORNIA <br />RESOLUTION NO_ PC-2005-60 <br />12_ESOLUTION APPROVING A CONDI"1'IONAL USE PERMIT FOR CATHY HIRATA AND <br />SANDY GASLENZ, WHERE MUSK BEGINS, AS FILED UNDER CASE PCUP-147 <br />WHEREAS, Cathy liirata and Sandy Gablenz, Where Music Begins, have applied for a <br />conditional use permit to operate a music studio in the existing building located at <br />5460 Sunol Boulevard, Suites 3 and 4; and <br />WHEREAS, zoning for the property is C-N (Neighborhood Commercial) District; and <br />W IIEREAS, at its duly noticed public hearing of December 1 4, 2005, the Planning <br />Commission considered -all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act ~CEQA~; and <br />WHEREAS, the Planning Commission made the following findings: <br />"I'he proposed location of the conditional use is in accordance with the <br />o bj ectivcs of the zoning ordinance and the purpose of the district in which <br />the site is located- <br />"1'he objectives of the zoning ordinance include fostering a harmonious, <br />convenient, workable relationship among land uses; protecting existing land use <br />from infiarmonious influences and fiarn~ful intrusions; and ensuring that public; <br />and private lands ultimately are used for the purposes which are most appropriate <br />and beneficial to the City as a whole- The subject music studio provides music <br />lessons in an enclosed area. Additionally, soundproofing would be added to the <br />common wall shared by the music studio and the immediately adjoining tenant to <br />minimize noise irnpacts_ Tfie proposed use would be compatible in the building <br />atid, with the proposed conditions of approval, will be operated in a manner <br />consistent with the above-cited objectives. <br />The site of the proposed use is located in the Oak Hills Shopping Center, which <br />permits a variety of conznzercial, personal service, and office uses. Establishing a <br />music studio in this shopping center would he in accordance: with the purposes of <br />the C-N zoning district to provide locations to offer commodities and services to <br />residents of Pleasanton and the surrounding residential neighborhood. The <br />proposed conditions of approval for the project would give the City the <br />appropriate controls to ensure that the use does not have any negative impacts on <br />
