NOW, THEREFORE, City and Owners hereby agree as follows: <br /> <br />1. Water and Sewer Service. Owners may connect to City's water and sewer system prior to <br />the City's annexation of the Property upon the satisfaction of the following conditions: <br /> <br /> (a) Owners shall pay the then-existing water and sewer connection fees for connecting <br /> to the City water and sewer system in accordance with applicable City ordinances and <br /> master fee schedules. <br /> <br /> (b) Owners shall pay all costs associated with extending the water and sewer system to <br /> serve the Property, said system to be designed in accordance with City standards and <br /> subject to City approval. <br /> <br /> (c) Owners shall pay an mount computed in accordance with the applicable City <br /> formula for connection to the water and sewer facility improvements subject to a mutual <br /> benefit district, reimbursement agreement, or any other agreement. <br /> <br /> (d) Owners shall pay a monthly water and sewer service charge as is now or may <br /> hereai~er be imposed. <br /> <br /> (e) Because the City is required to apply to LAFCo for this extension, Owners shall <br /> pay the processing fees to LAFCo. <br /> <br /> (f) Owners shall cooperate and assist the City in the City's efforts to annex the Remen <br /> Tract. <br /> <br />2. Agreement to Annex. Owners consent to annex to the City of Pleasanton the Property at <br />such time as City may require. This Agreement, State and County laws, and City ordinances and <br />resolutions shall control the responsibilities of both parties at the time of annexation. Owners <br />shall cooperate with City in the annexation of the Property, whether as pan of a larger area or as <br />pan of a smaller area; Owners expressly waive the right to protest said annexation and shall agree <br />to do no act calculated or tending to prevent, impede, or defeat the successful annexation of the <br />Property; provided, however, that Owners shall not waive their right to protest said annexation <br />should the City prior to annexation change the land use designation on the 1996 Pleasanton <br />General Plan applicable to the Remen Tract to a higher density. <br /> <br />3. No Further Subdivision. Owners shall not subdivide the Property without the prior <br />approval of the City. <br /> <br />4. Property Subject to This Agreement. The Property subject to this Agreement (including <br />any lot line adjustments thereto) shall be as more particularly described in the legal description and <br />map attached hereto as Exhibit A and made a part hereof. <br /> <br /> <br />
