Box 520 <br />Pleasanton, CA 94566 <br /> <br /> PREANNEXATION AGREEMENT <br /> <br /> TIllS AGREEMENT is made and entered into this 3rd day of June, 1997 between the <br />City ofPleasanton, a municipal corporation ("City") and Michael Faber, Carol Faber, Richard <br />Hempy and Rhonda Hempy ("Owners"), based on the following understandings: <br /> <br /> RECITALS <br /> <br /> A. Owners are the owners of certain real property ("the Property") more particularly <br />described in Exhibit A and incorporated herein by reference. <br /> <br /> B. Owners wish to connect to the City water and sewer system in order to eliminate <br />reliance on well water and to eliminate the need to construct a septic tank. <br /> <br /> C. Generally, City policy requires property to be annexed prior to extending such City <br /> services as water and sewer service. <br /> <br /> D. The City is investigating annexing the entire Remen Tract within which the <br />Property is located and Owners are willing to assist in this process. <br /> <br /> E. Owners are willing to annex the Property either as part of the larger Remen Tract <br /> annexation or as part of a smaller annexation involving the Property and other property <br /> contiguous to the City. <br /> <br /> F. The public health, safety, and welfare of City's residents are well served by <br /> eliminating the need for water wells and septic tanks and by connecting to the City's water and <br /> sewer system. <br /> <br /> G. City is willing to extend its water and sewer services only if there are assurances <br /> that the Property won't be further subdivided without approval from the City. <br /> <br /> (Agr~mentsXFab~.sam) <br /> 1 <br /> <br /> <br />
